PROPERTY DISCLOSURE STATEMENT

 On January 1st, 1995, a new Washington state law became effective requiring all sellers, including For Sale By Owners, to provide a written statement disclosing the conditions of the property. This statute requires you, the seller, to provide a "disclosure" on a prescribed form, to the buyer within five days of signing a purchase and sale agreement. (If you are located in another state you can call your local Association/Board of Realtors® and ask about legally required forms.)

The buyer has three days then to revoke the offer based on the "disclosure." This very well might be called the home "lemon law."

The regulation is designed to protect both the buyer, by providing a record of any defects or potential problems; and the seller, from any future liability as a result of defects discovered after the closing of a transaction.
